GENERAL INFORMATION

CBL SOLUTIONS S.A.S., identified with Tax ID (NIT) 901869086 and registered under the National Tourism Registry (RNT) No. 225082 (hereinafter referred to as “CBL SOLUTIONS”), is the owner of the business establishment known as AKAIRA TRAVEL, registered under number 80554502 (hereinafter referred to as “THE AGENCY”). In compliance with Law 300 of 1996, Law 1558 of 2012, Decree 2438 of 2010, Law 1480 of 2011 (Consumer Statute), and other applicable regulations, this document outlines the General Terms and Conditions governing the Services contracted by the User.


ARTICLE ONE: DEFINITIONS

The following definitions apply to this document:

General Conditions: Refers to the rules set forth in this document.
Deposit: Refers to the amount the User must pay to secure a reservation.
Accommodation: Lodging in carefully selected properties that ensure comfort and quality based on the type of tour chosen by the User.
Tour: Customized guided excursions.
Transportation: Transfer services to and from points of interest.
Service(s): Refers to the services provided by CBL SOLUTIONS within its facilities through AKAIRA.
AKAIRA: Refers to the business establishment named AKAIRA.
User: Refers to the person who has contracted the Service, whether or not they are the direct beneficiary.
Ecotourism: Tourism focused on the conservation and appreciation of nature, including eco-hikes, wildlife observation, picnics, cycling, and more.
Cultural Tourism: Promotes and explores the history, art, and traditions of a destination.
Gastro-Bar Tourism: Tourism centered around gastronomy and nightlife experiences.
Cancellation Penalty: Refers to the amount CBL SOLUTIONS is entitled to retain from the User as a penalty.
Check-In: The process of registering a User’s arrival at AKAIRA facilities.
Check-Out: The process of registering a User’s departure from AKAIRA facilities.
Arrival Date: The date the User must check in at AKAIRA facilities.
Departure Date: The date the User must check out from AKAIRA facilities.


ARTICLE TWO: SERVICE CONDITIONS

Check-In Time: Fully personalized according to the User’s arrival time and date. The User must present an identification document upon arrival. Minors are not allowed.
Check-Out Time: Fully personalized according to the User’s departure time and date.
Taxes: The Value Added Tax (VAT), set at 19% of the accommodation rate, applies to both Colombian and foreign residents in the country. VAT exemption for accommodation applies only to foreign nationals who enter Colombia with a tourist permit issued by immigration authorities. Confirmation is required when making the reservation.
Included Services:

  • Accommodation: Lodging in carefully selected establishments based on the tour chosen by the User.
  • Tour: A personalized guided excursion selected by the User.
  • Transportation: Includes transfers to/from points of interest, including airport-hotel on the arrival date and hotel-airport on the departure date.
  • Meals: Includes American breakfast and a variety of gastronomic options ranging from traditional dishes to menus tailored to the User’s preferences.
  • Medical Insurance: Coverage during the trip.
  • Customer Service: Personalized support for Users, including tour coordination, lodging arrangements, meal plans, flight itineraries, troubleshooting, booking management, plan changes, and more.
  • Driver: A dedicated driver available 24/7.
  • Cleaning Staff: Daily cleaning service during the stay.
  • Permanent Assistance: Staff available to ensure safety and address User requests promptly. This service is mandatory and cannot be declined by the User.

Additional Services:

  • Private Chef: Available at an additional cost, including meal plans and grocery purchases.
  • Souvenirs: Local products and keepsakes are available for purchase.

Additional Conditions:

  • Wildlife and flora are protected under Colombian law; illegal trading is prohibited (Laws 17 of 1981 and 299 of 1996).
  • The illegal trade of cultural assets is prohibited under Law 1185 of 2008.
  • Sexual exploitation of minors is strictly prohibited and punishable under Colombian law (Law 1336 of 2009).
  • Smoking in rooms and public areas is prohibited per Resolution 1956 of March 30, 2008.

ARTICLE THREE: RESERVATION PAYMENT

3.1 Prices: Prices are listed in COP and USD. Payments can be made in cash, credit/debit cards, or electronic methods like PSE or bank transfers. Prices are subject to change.
3.2 Deposit: Reservations are confirmed only after a deposit of 50% of the total service cost is paid.
3.3 Payment Deadline: The full payment must be made at least one week before the chosen package starts. Otherwise, the Service will be considered canceled, and a Cancellation Penalty will apply.
3.4 Cancellation Penalty: If the Service is unused, AKAIRA may retain 25% of the total plan cost as a penalty, refunding the remaining balance. Banking fees and taxes related to refunds will be borne by the User.
3.5 Right of Withdrawal: Users have a maximum of 5 business days to exercise their right of withdrawal under Law 1480 of 2011, unless the Service has already begun or the withdrawal occurs less than 5 days before the Arrival Date.
3.6 Refunds: Refunds for withdrawals will be processed within 30 business days. Refund timelines for credit card payments depend on the issuing bank.


ARTICLE FOUR: USER OBLIGATIONS

  • Comply with these General Conditions.
  • Abide by the terms of the tourism services contract.
  • Avoid any illegal conduct under Colombian law.
  • Safeguard personal belongings during the Service.

ARTICLE FIVE: MINORS

  • AKAIRA’s services cannot be purchased by minors.
  • The exploitation and abuse of minors are punishable under Colombian law (Article 17 of Law 679 of 2001).

ARTICLE SIX: LIABILITY CLAUSE

CBL SOLUTIONS is responsible for the Services sold, within the limits of these General Conditions. The User assumes all risks associated with their activities during the stay.


ARTICLE SEVEN: ACCEPTANCE

By purchasing or paying the deposit, the User agrees to these General Conditions.


ARTICLE EIGHT: SEVERABILITY

If any clause is deemed invalid, the remaining provisions will remain unaffected.


ARTICLE NINE: MODIFICATIONS

CBL SOLUTIONS reserves the right to amend these General Conditions, notifying the User in advance.


ARTICLE TEN: APPLICABLE LAW

These General Conditions are governed by Colombian law.
